WHEREAS,
DA Administrative Orders No. 10, Series of 2002, No. 6, Series
of 2003 and No. 11, Series of 2003 have adopted the Philippine
agricultural Engineering Standards (PAES) Volume 1, 11, and 111
respectively, and require all concerned DA Bureaus, Attached
Agencies, Corporations and Regional Field Units to comply with
these standards;
WHEREAS, the Philippine Agricultural Engineering
Standards Volumes 1, 11 and 111 covers standards on twenty one
(21) agricultural buildings and facilities used for the production,
processing and marketing of agricultural products and by-products;
WHEREAS, efficiently designed and well functioning
agricultural buildings and facilities that conform to the Philippine
Agricultural Engineering Standards are vital and necessary requirements
in the production, processing and marketing of agricultural fishery
products, and in the implementation of the Agriculture and Fisheries
Modernization Act of 1997;
WHEREAS, the Board of Agricultural Engineering
BOAE) of the Professional Regulations Commission through its
Resolutions No. 05, series of 2002, No. 1, Series of 2003 and
No. 2, Series of 2003 have adopted and promulgated the Philippine
Agricultural Engineering Standards Volumes 1, 11 and 111 as the
Code of Technical Standards of Agricultural Engineering which
shall serve as technical reference by all duly registered agricultural
engineers in the signing and sealing of plans, designs, specifications
and other documents for agricultural buildings, machineries and
other agricultural facilities pursuant to Sections 9(h) and 21
of R.A. 8559, Section 40 of the IRR of R.A. 8559, and BOAE Resolution
No. 07, Series of 2003;
WHEREAS, Section 701 (a10) of Presidential Decree
No. 1096 otherwise known as National Building Code of the Philippines
covers agricultural buildings as one of its scope of application,
whereby, the Philippine Agricultural Engineering Standards need
to be integrated in the implementation of the said code;
WHEREAS, pursuant to Title IV, Chapter 1, Section
3 (2) of the Administrative Code of 1987, the Department of Agriculture
is responsible for the planning, formulation and execution, regulation
and monitoring of programs and activities relating to agriculture,
food production and supply;
NOW
THEREFORE, in view of
the above, the existing Philippine Agricultural Engineering Standards
are hereby enforced as integral parts in the design, construction
and maintenance of agricultural buildings and facilities, and
for this purpose, the following measures and directives are hereby
issued:
SECTION
1. Coverage - The following
Philippine Agricultural Engineering Standards (PAES) adopted
through DA Administrative Orders No. 10, Series of 2002, No.
6, Series of 2003 and No. 11, Series of 2003 shall be enforced
in the design, construction, repair and maintenance agricultural
buildings and facilities:
1. Housing of Broiler Production
- PAES 402 : 2001
2. Housing for Layer Production - PAES 403 : 2001
3. Housing for Swine Production - PAES 4-1 : 2001
4. Housing for Goats and Sheeps - PAES 404 : 2001
5. Cattle Feedlot - PAES 405 : 2001
6. Cattle Ranch - PAES 406 : 2001
7. Housing for Dairy Cattle - PAES 407 : 2001
8. Carabao Feedlot - PAES 408 : 2001
9. Milking Parlor - PAES 409 : 2002
10. Lairage for Swine, Small and Large Animals - PAES 410 : 2000
11. slaughterhouse for Swine, Small and Large Animals - PAES
411 : 2000
12. Dressing Plant - PAES 412 : 2002
13. Greenhouse - PAES 415 : 2001
14. Tissue Culture Laboratory - PAES 416 : 2002
15. Fruit and Vegetable Storage - PAES 417 : 2002
16. Processing Plant for Fresh Fruit and Vegetables - PAES 418

The standards of other types
of agricultural buildings and facilities shall also be enforced
following its adoption by its Department.
SECTION
2. Enforcement Mechanism
- The enforcement of the Philippine Agricultural Engineering
Standards on agricultural buildings and facilities shall be carried
out by this Department through its concerned bureaus, attached
agencies and regional field units. The Office of the Assistant
Secretary for Field Operation shall serve as the National Enforcement
Coordinating Office, and shall be assisted b the DA National
Coordinator on Agricultural Engineering and pool of DA agricultural
engineers.
SECTION
3. Standards Compliance
Certificate - The Assistant Secretary for Field Operation in
collaboration with concerned DA Bureaus and Attached Agencies
such as BPRE, BAI, BPI, BFAR, NMIC, PCA, FIDA, NAFC and NFA shall
develop the procedures and mechanism for the issuance of Standards
Compliance Certificate (SCC) to concerned individuals or groups
who shall construct, repair or operate agricultural buildings
and facilities. As basis for evaluation towards the issuance
of the Standards Compliance Certificate, concerned individuals
and groups shall submit 5 sets of plans, designs, specifications
and other technical documents duly signed and sealed by a registered
agricultural engineer/s.
SECTION
4. PAES Application on
the National Building Code - The Assistant Secretary for Field
Operation in collaboration with the Philippine Society of Agricultural
Engineers and the Board of Agricultural Engineering of the Professional
Regulation Commission shall immediately coordinate with the Department
of Public Works and Highways and the Department of Interior and
Local Government for the integration of the Philippine Agricultural
Engineering Standards of agricultural buildings and facilities
in the implementation of the National Building Code, in particular
in the issuance of building permits and certificate of occupancy.
SECTION
5. Role of the DA Regional
Agricultural Engineering Divisions - The Regional Agricultural
Engineering Divisions (RAED) of the DA Regional Field Units shall
serve as the enforcement arm of this Department on the Philippine
Agricultural Engineering Standards on agricultural buildings
and facilities.
The
RAED, in the performance of its functions shall coordinate
and mobilize the support and involvement of the Provincial, City
and Municipal Agricultural engineering Groups / Units of the
Local Government Units.
SECTION
6. Repealing Clause -
All DA Administrative Orders, Special Orders and other issuances
inconsistent to this administrative Order are hereby repealed
and/or modified accordingly.
SECTION
7. Effectivity - This
Order shall take effect after fifteen (15) days following the
publication in the Official Gazette or any newspaper of general
circulation, whichever is earlier.
